BarrieAutoQuote — Terms of Service

Last Updated: October 2026
Jurisdiction: Province of Ontario and the Federal Laws of Canada applicable therein

1. Introduction and Agreement to Terms

Welcome to BarrieAutoQuote ("BarrieAutoQuote", "Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website located at barrieautoquote.ca (the "Website"), our pricing calculation engine, lead intake interfaces, and related automotive referral services (collectively, the "Services").

By accessing or using our Website and Services, submitting vehicle information, or requesting price verification, you ("User", "you", or "your") acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must discontinue use of the Services immediately.

2. Nature of Services: Independent Benchmark Guide & Referral Platform

BARRIEAUTOQUOTE IS NOT A REGISTERED MOTOR VEHICLE REPAIR FACILITY, LICENSED AUTOMOTIVE GARAGE, OR CERTIFIED TECHNICIAN.

2.1. Informational Pricing Benchmarks:
All figures, dollar amounts, labor hours, and price ranges displayed on our Website (including quotes for brake repairs, oil services, tire swaps, alternators, radiators, batteries, wheel bearings, and suspension work) represent independent market benchmarks and non-binding informational estimates. These benchmarks are generated through proprietary algorithmic formulas referencing industry standard labor manuals (e.g., Mitchell 1, Alldata) and prevailing independent door rates in Barrie, Innisfil, and Springwater (Simcoe County, Ontario).

2.2. No Binding Repair Contracts:
The pricing benchmarks displayed on the Website do not constitute a formal, binding contract for repair, nor do they represent an offer to perform mechanical services at a guaranteed price.

2.3. Referral Agency Role:
BarrieAutoQuote acts solely as an independent pricing guide, customer advocate, and introduction service connecting vehicle owners with third-party, independently owned and operated automotive repair facilities ("Partner Facilities" or "Service Facilities"). We do not own, operate, supervise, inspect, or control any repair facility, bay, hoist, tool, employee, or subcontractor.

3. Ontario Consumer Protection Act Compliance & On-Site Estimates

3.1. Statutory Written Estimates:
Under the Ontario Consumer Protection Act, 2002 (and specifically the Motor Vehicle Repair regulations thereunder, O. Reg. 17/05), a repair facility cannot charge an amount exceeding 10% of a written estimate provided to a consumer without prior authorization.

3.2. Teardown and Physical Hoist Inspection:
The benchmark provided on BarrieAutoQuote is calculated remotely prior to visual or mechanical inspection. You acknowledge that an enforceable, formal written estimate under Ontario law can only be provided directly by the licensed motor vehicle repair facility following physical teardown and visual hoist inspection.

3.3. Concealed Rust, Seizure, and Pre-Existing Damage:
In Simcoe County and the Ontario salt belt, vehicles are frequently subject to road-brine corrosion, seized caliper pins, swollen wheel fasteners, oxidized wheel hubs, broken sway bar studs, and stripped fasteners. The final written repair order provided by the Partner Facility will reflect actual physical teardown conditions and may require additional parts or labor not identifiable via remote algorithmic benchmarking. You are under no obligation to authorize repair work beyond the initial inspection.

4. Pricing, Taxes, and Payment Terms

4.1. Currency and Ontario Harmonized Sales Tax (HST):
All prices, estimates, benchmarks, and fee ranges stated on the Website and in dispatch SMS/email notifications are expressed in Canadian Dollars (CAD) and strictly exclude 13% Ontario Harmonized Sales Tax (HST) unless expressly noted otherwise. Applicable HST and mandatory municipal/provincial tire or battery stewardship eco-fees will be itemized by the Partner Facility on your final counter invoice.

4.2. Payment Directly to Facility:
Unless an explicit booking deposit is collected via our platform using a secure third-party payment processor (e.g., Stripe), you pay the Partner Facility directly at their physical counter upon completion of work and delivery of your vehicle. BarrieAutoQuote does not collect, hold, or disburse repair proceeds on behalf of repair facilities.

5. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE CANADIAN AND ONTARIO LAW:

5.1. THE SERVICES, CALCULATIONS, DIRECTORY LISTINGS, AND BENCHMARKS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR COLLATERAL.

5.2. BARRIEAUTOQUOTE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

6. Limitation of Liability and Indemnification

6.1. Direct, Indirect, and Consequential Damages:
Under no circumstances shall BarrieAutoQuote, its founders, directors, officers, employees, affiliates, or agents be liable to you or any third party for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with:

6.2. Total Aggregate Liability:
In all events, the total cumulative liability of BarrieAutoQuote arising out of or related to these Terms or your use of the Services shall be strictly limited to the greater of: (a) the amount paid by you directly to BarrieAutoQuote for our referral service (if any) in the preceding three (3) months; or (b) $50.00 CAD.

6.3. Indemnification:
You agree to indemnify, defend, and hold harmless BarrieAutoQuote and its officers, directors, and agents from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your vehicle's mechanical condition; or (c) your interactions or transactions with any Partner Facility.

7. User Representations, Accuracy of Submissions, and Communications

7.1. Accurate Vehicle Specifications:
When submitting a request on index.html, you agree to provide truthful, accurate, and current vehicle details (model year, engine displacement, drivetrain, observed mechanical symptoms, and contact information). Providing inaccurate information may result in invalid benchmarks or hoist scheduling cancellations.

7.2. Consent to Commercial Electronic Messages (CASL):
By submitting your phone number and email address through our lead intake form, you provide express consent under Canada’s Anti-Spam Legislation (CASL) for BarrieAutoQuote and its designated Partner Facility to contact you via telephone call, SMS/text message, or email specifically regarding your requested quote, price verification, hoist availability, and appointment scheduling. You may withdraw consent to non-transactional marketing messages at any time. Standard carrier messaging and data rates may apply.

8. Third-Party Websites and Commercial Relationships

Our Website may contain hyperlinks to third-party automotive parts distributors, mapping services (e.g., Google Maps), or local facility websites. BarrieAutoQuote does not endorse, control, or guarantee the contents, terms, or privacy practices of these external sites.

BarrieAutoQuote maintains commercial referral and advertising partnerships with select independent automotive facilities across Simcoe County. In certain instances, facilities pay a flat subscription or referral fee to BarrieAutoQuote upon vehicle dispatch or completed repair. This commercial relationship does not alter your statutory rights with the repair facility under Ontario law.

9. Intellectual Property

All software, algorithms, codebases, user interfaces, branding, logos, trademarks, copywriting, and proprietary multi-lens calculation matrices displayed on the Website are the exclusive intellectual property of BarrieAutoQuote. You may not copy, reverse-engineer, decompile, scrape, reproduce, redistribute, or create derivative works from our Website without prior written authorization.

10. Governing Law, Jurisdiction, and Dispute Resolution

10.1. Governing Law:
These Terms, your use of the Services, and all disputes arising hereunder shall be governed by, construed, and enforced in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

10.2. Exclusive Forum:
Any legal action, suit, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the courts located in Barrie, Ontario, Canada, and each party irrevocably submits to the personal and exclusive jurisdiction of such courts.

11. Amendments and Severability

We reserve the right to revise or replace these Terms at any time in our sole discretion. Updated versions will be posted to the Website with a revised "Last Updated" date. Your continued use of the Website following any changes constitutes acceptance of the modified Terms.

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be severed, and the remaining provisions shall continue in full force and effect.
